Article 78 of the French Code of civil procedure

The judge may, in the same judgment, but by separate provisions, declare himself competent and rule on the merits of the dispute, after having, where appropriate, first given the parties notice to conclude on the merits.

Le juge peut, dans un même jugement, mais par des dispositions distinctes, se déclarer compétent et statuer sur le fond du litige, après avoir, le cas échéant, mis préalablement les parties en demeure de conclure sur le fond.
