Where the succession has been accepted by one or more heirs purely and simply and by one or more others to the extent of the net assets, the rules applicable to the latter option are binding on all the heirs until the day of partition.

The creditors of an estate accepted by one or more heirs purely and simply and by others up to the amount of the net assets may bring about the partition provided that they justify difficulties in recovering the share of their claim incumbent on the accepting heirs up to the amount of the net assets.

Lorsque la succession a été acceptée par un ou plusieurs héritiers purement et simplement et par un ou plusieurs autres à concurrence de l’actif net, les règles applicables à cette dernière option s’imposent à tous les héritiers jusqu’au jour du partage.

Les créanciers d’une succession acceptée par un ou plusieurs héritiers purement et simplement et par d’autres à concurrence de l’actif net peuvent provoquer le partage dès lors qu’ils justifient de difficultés dans le recouvrement de la part de leur créance incombant aux héritiers acceptants à concurrence de l’actif net.
