Article 811 of the French Code of Criminal Procedure

For the application of the first paragraph of Article 46 and article 48, the functions of the public prosecutor may also be performed by a judicial police officer belonging to the gendarmerie.

For the application of the second paragraph of article 46, the duties of the public prosecutor may also be performed by the head of the administrative district or subdivision where the police court has its seat.

Pour l’application du premier alinéa de l’article 46 et de l’article 48, les fonctions du ministère public peuvent également être exercées par un officier de police judiciaire appartenant à la gendarmerie.

Pour l’application du deuxième alinéa de l’article 46, les fonctions du ministère public peuvent être également exercées par le chef de la circonscription ou de la subdivision administrative où siège le tribunal de police.
