Article 812-3 of the French Civil Code

The remuneration of the mandatary is a charge on the estate which gives rise to a right to reduction where it has the effect of depriving the heirs of all or part of their reserve. The heirs covered by the mandate or their representatives may apply to the courts for a review of the remuneration where they can justify that it is excessive in relation to the duration or the burden resulting from the mandate.

La rémunération du mandataire est une charge de la succession qui ouvre droit à réduction lorsqu’elle a pour effet de priver les héritiers de tout ou partie de leur réserve. Les héritiers visés par le mandat ou leurs représentants peuvent demander en justice la révision de la rémunération lorsqu’ils justifient de la nature excessive de celle-ci au regard de la durée ou de la charge résultant du mandat.
