Article 815-2 of the French Civil Code

Any undivided co-owner may take the measures necessary for the conservation of the undivided property even if they are not of an emergency nature.

He may use for this purpose the undivided property funds held by him and he is deemed to have free disposal of them with regard to third parties.

In the absence of undivided property funds, he may oblige his co-undividers to make the necessary expenditure with him.

Where undivided property is encumbered by a usufruct, these powers are enforceable against the usufructuary insofar as the latter is liable for repairs.

Tout indivisaire peut prendre les mesures nécessaires à la conservation des biens indivis même si elles ne présentent pas un caractère d’urgence.

Il peut employer à cet effet les fonds de l’indivision détenus par lui et il est réputé en avoir la libre disposition à l’égard des tiers.

A défaut de fonds de l’indivision, il peut obliger ses coïndivisaires à faire avec lui les dépenses nécessaires.

Lorsque des biens indivis sont grevés d’un usufruit, ces pouvoirs sont opposables à l’usufruitier dans la mesure où celui-ci est tenu des réparations.
