Article 821 of the French Civil Code

Failing an amicable agreement, the joint ownership of any agricultural, commercial, industrial, craft or liberal enterprise, which was operated by the deceased or his spouse, may be maintained under the conditions set by the court at the request of the persons mentioned in Article 822.

Where applicable, the application to maintain indivision may relate to corporate rights.

The court decides on the basis of the interests involved and the means of existence that the family can derive from the undivided property.

The maintenance of undivided ownership remains possible even where the business includes items of which the heir or spouse was already the owner or co-owner before the opening of the succession.

Article 821

A défaut d’accord amiable, l’indivision de toute entreprise agricole, commerciale, industrielle, artisanale ou libérale, dont l’exploitation était assurée par le défunt ou par son conjoint, peut être maintenue dans les conditions fixées par le tribunal à la demande des personnes mentionnées à l’article 822.

S’il y a lieu, la demande de maintien de l’indivision peut porter sur des droits sociaux.

Le tribunal statue en fonction des intérêts en présence et des moyens d’existence que la famille peut tirer des biens indivis.

Le maintien de l’indivision demeure possible lors même que l’entreprise comprend des éléments dont l’héritier ou le conjoint était déjà propriétaire ou copropriétaire avant l’ouverture de la succession.
