Article 824 of the French Civil Code

If undivided co-owners intend to remain in undivided ownership, the court may, at the request of one or more of them, depending on the interests involved and without prejudice to the application of the articles 831 to 832-3, allocate his share to the person who requested partition.

If there is not a sufficient sum in the undivided property, the remainder is paid by those undivided co-owners who have contributed to the request, without prejudice to the possibility for the other undivided co-owners to participate, if they express a wish to do so. The share of each undivided co-owner is increased in proportion to his payment.

Si des indivisaires entendent demeurer dans l’indivision, le tribunal peut, à la demande de l’un ou de plusieurs d’entre eux, en fonction des intérêts en présence et sans préjudice de l’application des articles 831 à 832-3, attribuer sa part à celui qui a demandé le partage.

S’il n’existe pas dans l’indivision une somme suffisante, le complément est versé par ceux des indivisaires qui ont concouru à la demande, sans préjudice de la possibilité pour les autres indivisaires d’y participer, s’ils en expriment la volonté. La part de chacun dans l’indivision est augmentée à proportion de son versement.
