Article 832-3 of the French Civil Code

Preferential allotment may be applied for jointly by several successors in order to keep the undivided property together.

Failing amicable agreement, the application for preferential allotment is brought before the court, which decides on the basis of the interests involved.

In the event of competing applications, the court takes into account the ability of the various applicants to manage the property in question and to remain in it. For the business, the court takes particular account of the length of personal involvement in the business.

L’attribution préférentielle peut être demandée conjointement par plusieurs successibles afin de conserver ensemble le bien indivis.

A défaut d’accord amiable, la demande d’attribution préférentielle est portée devant le tribunal qui se prononce en fonction des intérêts en présence.

En cas de demandes concurrentes, le tribunal tient compte de l’aptitude des différents postulants à gérer les biens en cause et à s’y maintenir. Pour l’entreprise, le tribunal tient compte en particulier de la durée de la participation personnelle à l’activité.
