Article 845 of the French Civil Code

An heir who renounces the succession may, however, retain the inter vivos gift or claim the legacy made to him up to the available portion unless the disposing person has expressly required the report in the event of renunciation.

In this case, the report is made in value. Where the value reported exceeds the rights he should have had in the partition if he had participated in it, the renouncing heir compensates the accepting heirs up to the amount of this excess.

L’héritier qui renonce à la succession peut cependant retenir le don entre vifs ou réclamer le legs à lui fait jusqu’à concurrence de la portion disponible à moins que le disposant ait expressément exigé le rapport en cas de renonciation.

Dans ce cas, le rapport se fait en valeur. Lorsque la valeur rapportée excède les droits qu’il aurait dû avoir dans le partage s’il y avait participé, l’héritier renonçant indemnise les héritiers acceptants à concurrence de cet excédent.
