Article 849-10 of the French Code of civil procedure

Once the period allowed for the person responsible for the breach to submit his observations has expired, the judge sets the third party’s remuneration on the basis, in particular, of the care taken, the time allowed and the quality of the work provided.

The judge authorises the third party to have the sums deposited in the court registry returned to him in due proportion.
It authorises the third party to recover the sums deposited with the court registry. It shall order, as appropriate, either the payment of any additional sums due to the third party or the return of any sums deposited in excess of this amount.

Where the judge intends to set the third party’s remuneration at an amount lower than the amount requested, he must first invite the third party to submit his observations.

The judge issues an enforcement order to the third party.

Passé le délai imparti à l’auteur du manquement pour présenter ses observations, le juge fixe la rémunération du tiers en fonction, notamment, des diligences accomplies, du respect des délais impartis et de la qualité du travail fourni.


Il autorise le tiers à se faire remettre, à due concurrence, les sommes consignées au greffe. Il ordonne, selon le cas, soit le versement des sommes complémentaires dues au tiers, soit la restitution des sommes consignées en excédent.


Lorsque le juge envisage de fixer la rémunération du tiers à un montant inférieur au montant demandé, il doit au préalable l’inviter à formuler ses observations.


Le juge délivre au tiers un titre exécutoire.
