Article 849-14 of the French Code of civil procedure

Joining the group takes the form of a request for compensation. It shall be made by any means enabling receipt to be acknowledged, in accordance with the procedures and within the time limit determined by the judge:

1° To one of the parties to the proceedings where the individual compensation procedure is applied;

> To the claimant in the proceedings where the individual compensation procedure is applied;

To the claimant in the proceedings where the individual compensation procedure is applied
2° To the claimant in the action where the collective procedure for the settlement of damages is applied.

>The claim form must be signed by the claimant.
In particular, it shall contain the surname, forenames and home address of the person concerned and, where applicable, an e-mail address at which that person agrees to receive information relating to the proceedings.

The request shall show that the criteria laid down in the collective proceedings are met.
This request must show that the criteria for inclusion in the group have been met.

L’adhésion au groupe prend la forme d’une demande de réparation. Elle est faite par tout moyen permettant d’en accuser la réception, selon les modalités et dans le délai déterminé par le juge :


1° Auprès de l’une des parties à l’instance lorsqu’il est fait application de la procédure individuelle de réparation des préjudices ;


2° Auprès du demandeur à l’action lorsqu’il est fait application de la procédure collective de liquidation des préjudices.


Elle contient notamment les nom, prénoms, domicile de la personne intéressée ainsi que, le cas échéant, une adresse électronique à laquelle elle accepte de recevoir les informations relatives à la procédure.


Cette demande justifie que les critères de rattachement au groupe sont remplis.
