Article 849-4 of the French Code of civil procedure

As soon as the decision designating a third party has been handed down, the court registry shall notify the third party of a copy by any means.

The third party shall inform the judge of his acceptance without delay. He shall commence his operations as soon as he is notified of the payment of the advance referred to in Article 849-5, unless the judge instructs him to commence his operations immediately.

Dès le prononcé de la décision désignant un tiers, le greffe lui en notifie copie par tout moyen.


Le tiers fait connaître sans délai au juge son acceptation. Il commence ses opérations dès qu’il est avisé du versement de la provision mentionnée à l’article 849-5, à moins que le juge ne lui enjoigne d’entreprendre immédiatement ses opérations.
