Article 855 of the French Code of civil procedure

In addition to the information prescribed by articles 54 and 56, the surname, first names and address of the person with whom the claimant elects domicile in France if he or she resides abroad.

The document instituting proceedings shall also mention the conditions under which the defendant may or must be assisted or represented, where applicable, the name of the claimant’s representative and, where it contains a claim for payment, the provisions of Article 861-2.

L’assignation contient, à peine de nullité, outre les mentions prescrites par les articles 54 et 56, les nom, prénoms et adresse de la personne chez qui le demandeur élit domicile en France s’il réside à l’étranger.


L’acte introductif d’instance mentionne en outre les conditions dans lesquelles le défendeur peut ou doit se faire assister ou représenter, s’il y a lieu, le nom du représentant du demandeur ainsi que, lorsqu’il contient une demande en paiement, les dispositions de l’article 861-2.
