Article 857 of the French Code of civil procedure

The matter is referred to the court, at the request of either party, by delivering a copy of the summons to the court registry.

This remittance must take place no later than eight days before the date of the hearing, failing which the summons will lapse automatically by order, as the case may be, of the president or of the judge hearing the case, or, failing this, at the request of a party.

Le tribunal est saisi, à la diligence de l’une ou l’autre partie, par la remise au greffe d’une copie de l’assignation.

Cette remise doit avoir lieu au plus tard huit jours avant la date de l’audience, sous peine de caducité de l’assignation constatée d’office par ordonnance, selon le cas, du président ou du juge chargé d’instruire l’affaire, ou, à défaut, à la requête d’une partie.
