Article 861 of the French Civil Code

Where the return is in kind and the condition of the objects given has been improved by the act of the donee, he must be taken into account for this, having regard to what their value was increased at the time of the partition or alienation.

The donee must likewise be taken into account for the necessary expenses he has made for the conservation of the property, even if they have not improved it.

Lorsque le rapport se fait en nature et que l’état des objets donnés a été amélioré par le fait du donataire, il doit lui en être tenu compte, eu égard à ce dont leur valeur se trouve augmentée au temps du partage ou de l’aliénation.

Il doit être pareillement tenu compte au donataire des dépenses nécessaires qu’il a faites pour la conservation du bien, encore qu’elles ne l’aient point amélioré.
