Article 906 of the French Civil Code

To be capable of receiving inter vivos, it is sufficient to be conceived at the time of the gift.

To be capable of receiving by will, it is sufficient to be conceived at the time of the testator’s death.

Nevertheless, the gift or will will only have effect as long as the child is born viable.

Pour être capable de recevoir entre vifs, il suffit d’être conçu au moment de la donation.

Pour être capable de recevoir par testament, il suffit d’être conçu à l’époque du décès du testateur.

Néanmoins, la donation ou le testament n’auront leur effet qu’autant que l’enfant sera né viable.
