Article 912-2 of the French Cinema and Moving Image Code

In order to help limit the risk of cinemas becoming overcrowded when they reopen to the public due to the very large number of works whose exhibition has been prevented because of the measures banning admission to the public, works whose first form of exhibition is not the cinemas for which they were initially intended may, by way of derogation from article 211-6, be considered eligible for financial assistance for the production and preparation of long-run cinematographic works.
Delegated production companies may benefit from the provisions of the previous paragraph if they submit a request no later than three months after the date on which the ban on admission to cinemas ceases.
The request must be sent to the Centre national du cinéma et de l’image animée by electronic means. It must be accompanied by a sworn statement to the effect that the delegated production company has obtained the agreement of the authors, co-producers, distributor and companies with which it has concluded a financing contract for the production of the work for a first form of exhibition other than cinemas, as well as the agreement of the co-producers and the aforementioned companies with regard to subsequent windows of exhibition.

Afin de contribuer à la limitation du risque d’encombrement des salles de spectacles cinématographiques lors de leur réouverture au public tenant au très grand nombre d’œuvres dont l’exploitation a été empêchée en raison des mesures d’interdiction d’accueil du public, peuvent, par dérogation à l’article 211-6, être regardées comme éligibles aux aides financières à la production et à la préparation des œuvres cinématographiques de longue durée les œuvres dont la première forme d’exploitation n’est pas l’exploitation en salles à laquelle elles étaient initialement destinées.
Le bénéfice des dispositions de l’alinéa précédent est ouvert aux entreprises de production déléguées qui en font la demande au plus tard trois mois après la date de cessation de l’interdiction d’accueil du public.
La demande est adressée au Centre national du cinéma et de l’image animée par voie électronique. Elle est accompagnée d’une attestation sur l’honneur indiquant que l’entreprise de production déléguée a obtenu l’accord des auteurs, des coproducteurs, du distributeur et des entreprises avec lesquelles elle a conclu un contrat de financement pour la production de l’œuvre pour une première forme d’exploitation autre que la salle de spectacles cinématographiques ainsi que l’accord des coproducteurs et des entreprises précitées en ce qui concerne les fenêtres d’exploitation postérieures.
