Article 913-2 of the French Cinema and Moving Image Code

A delegated production company wishing to receive assistance from the compensation fund in the event of an incident during filming must have joined the fund prior to the incident and any request for assistance.
To this end, the delegated production company fills in, electronically, a form drawn up by the Centre national du cinéma et de l’image animée, accompanied by the insurance contract it has taken out for the work concerned, including cover for the unavailability of persons. However, the delegated production company may provide the contract taken out by a co-producer under the terms of which it also benefits from insurance cover, provided that this contract was taken out before the entry into force of deliberation no. 2020/CA/11 of 29 May 2020 or that the work concerned is produced as part of a co-production mentioned in b of 2° of article 913-4 in which French participation is a minority.

Article 913-2

L’entreprise de production déléguée qui souhaite, en cas de survenance d’un sinistre sur un tournage, bénéficier d’une aide du fonds d’indemnisation doit avoir adhéré au fonds préalablement à la survenance du sinistre et à toute demande d’aide.
A cette fin, l’entreprise de production déléguée remplit, par voie électronique, un formulaire établi par le Centre national du cinéma et de l’image animée, accompagné du contrat d’assurance qu’elle a souscrit pour l’œuvre concernée comportant une garantie relative à l’indisponibilité des personnes. Toutefois, l’entreprise de production déléguée peut fournir le contrat souscrit par un coproducteur aux termes duquel elle bénéficie également de la couverture assurantielle, dès lors que ce contrat a été conclu avant l’entrée en vigueur de la délibération n° 2020/CA/11 du 29 mai 2020 ou que l’œuvre concernée est produite dans le cadre d’une coproduction mentionnée au b du 2° de l’article 913-4 dans laquelle la participation française est minoritaire.
