Article 919 of the French Civil Code

The available portion may be given in whole or in part either by inter vivos deed or by will, to the children or other successors of the donor, without being subject to report by the donee or legatee coming to the succession, provided that as regards gifts the disposition has been made expressly and outside the share of the succession.

The declaration that the gift is outside the share of the succession may be made, either by the deed containing the disposition, or subsequently, in the form of dispositions inter vivos or testamentary.

La quotité disponible pourra être donnée en tout ou en partie soit par acte entre vifs, soit par testament, aux enfants ou autres successibles du donateur, sans être sujette au rapport par le donataire ou le légataire venant à la succession, pourvu qu’en ce qui touche les dons la disposition ait été faite expressément et hors part successorale.

La déclaration que la donation est hors part successorale pourra être faite, soit par l’acte qui contiendra la disposition, soit postérieurement, dans la forme des dispositions entre vifs ou testamentaires.
