Article A123-49 of the French Commercial code

Applications for registration of savings and provident institutions or, where applicable, for amending registration shall be accompanied by the following supporting documents:

1° The receipt for the filing of the deeds and documents if the formality is not concurrent with the filing;

2° In the event of a merger or demerger, a registration extract for each of the savings banks participating in the merger or demerger operation;

3° For natural persons with the general power to bind the savings and provident institutions, for members of the guidance and supervisory board, all official documents proving identity and nationality and, if they are foreigners, the documents entitling them to reside on French territory;

4° For legal entities that are members of the Guidance and Supervisory Board, an extract from their registration in the Trade and Companies Register or the title justifying their legal capacity and for the permanent representative who is not the chairman of the board of directors or the manager of the legal entity, a copy of the decision conferring this capacity on him;

5° For statutory auditors, proof of their registration on the list of statutory auditors.

Les demandes d’immatriculation des caisses d’épargne et de prévoyance ou, le cas échéant, d’inscription modificative sont accompagnées des pièces justificatives suivantes :

1° Le récépissé du dépôt des actes et pièces si la formalité n’est pas concomitante au dépôt ;

2° En cas de fusion ou de scission, un extrait d’immatriculation de chacune des caisses d’épargne participant à l’opération de fusion ou de scission ;

3° Pour les personnes physiques ayant le pouvoir général d’engager les caisses d’épargne et de prévoyance, pour les membres du conseil d’orientation et de surveillance, tous documents officiels justificatifs de l’identité et de la nationalité et, s’ils sont étrangers, les titres qui les habilitent à séjourner sur le territoire français ;

4° Pour les personnes morales, membres du conseil d’orientation et de surveillance, un extrait de l’immatriculation au registre du commerce et des sociétés ou le titre justifiant leur capacité juridique et pour le représentant permanent qui n’est pas le président du conseil d’administration ou le gérant de la personne morale, une copie de la décision lui conférant cette qualité ;

5° Pour les commissaires aux comptes, la justification de leur inscription sur la liste des commissaires aux comptes.
