1° The identity of the applicant: surname, first name and address if the applicant is a natural person or, if the applicant is a legal entity, name or company name, legal form, corporate purpose, address of registered office, registration number in the Trade and Companies Register or, failing this, a statement of the formalities of incorporation;
2° The capacity in which the applicant is acting: operator or future operator of the cinema, owner or future owner of the buildings, promoter. If the applicant is not the operator, he must indicate the identity of the person who is or will be the holder of the authorisation to operate a cinema entertainment establishment;
3° The brand name under which the cinema entertainment establishment is or will be operated;
4° The name of the municipality in which the film entertainment establishment is located and the nature of this location depending on whether it is isolated, located in a concerted activity zone or in a commercial zone or whether it is part of an overall town planning operation;
5° A cadastral plan specifying the parcels concerned and the surface area of the land accompanied, for all of these parcels, by one of the following documents:
a) Title deeds to the property concerned;
b) Title deeds authorising construction on the plots concerned;
c) Title deeds authorising the applicant to commercially exploit the plots concerned.
In the absence of one of these titles, the applicant may produce a notarised certificate showing the name of the beneficiary of the title, the identification of the properties concerned and the period of validity of the title;
6° The demarcation of the area of cinematographic influence of the cinematographic entertainment establishment;
7° An indication of the total population present in the area of cinematographic influence and the population of each municipality included in this area as well as its evolution between the last two censuses authenticated by decree;
8° The number of cinemas in the cinema and the number of spectator places in each of its cinemas and, for projects involving an extension, an indication of the number of cinemas and spectator places per existing and planned cinema;
9° A list of the devices and equipment planned to make the establishment accessible to disabled people, as well as any consultations held with associations representing disabled people;
10° A list of cinemas located in the cinematographic influence zone, specifying the number of screens and audience places for each and whether they belong to a programming agreement or group;
11° A map showing the cinematographic establishments located in the cinema catchment area;
12° A study to assess the foreseeable effects of the project with regard to the criteria set out in article L. 212-9 and justifying compliance with the principles set out in article L. 212-6. This study includes:
a) Elements making it possible to assess the potential effect of the project on the cinematographic diversity offered to spectators, indicating:
-the programming project envisaged for the cinematographic establishment, evaluating its contribution to the diversity of the cinematographic offer in the area of cinematographic influence with regard to the expected overall cinematographic attendance; this project includes an estimate of the percentage of screenings devoted respectively to art house films in general, art house films released in cinemas on more than 150 copies, art house films for young audiences, art house heritage films and films broadcast in their original version;
the type of programming seen in cinemas located in the area of cinematographic influence, in relation to overall cinema attendance in the area;
-if applicable, the difficulties encountered by the applicant in accessing cinematographic works;
b) Information enabling the potential impact of the project on the cultural development of the area, environmental protection and the quality of town planning to be assessed, indicating:
-the importance of the project in relation to the geographical distribution of cinemas in the catchment area and the distribution of the population concerned;
-the level of cultural activity in cinemas in the catchment area and that envisaged as part of the project;
-the potential effect of the project on the balance between the different types of cinemas in the catchment area;
the accessibility of the establishment, the various existing or future modes of public transport, pedestrian and cycle access, road access and traffic flows in the cinema catchment area, the various existing or future car parks in the vicinity of the cinema and the number of existing or planned spaces in these car parks;
-the architectural characteristics of the project in relation to its surroundings;
-the relevance of the location of the project in relation to the regional coherence plan and the local town planning scheme.
