Article A444-102 of the French Commercial code

Sales by judicial auction of all goods and rights other than movable and movable objects, retail trees, and boats (number 69 of table 5) give rise, to the collection:

1° If the specifications drawn up by the notary, of a proportional emolument, according to the following scale:

From €17,000 to €60,000 1.995%
More than €60,000 1.497%

2° If the specifications are drawn up by the lawyer, a proportional fee, according to the following scale:

From €6,500 to €17,000 1.596%
From €17,000 to €60,000 1.064%
Over €60,000 0.799%

When the auction price does not exceed €30, the notary is only entitled to the reimbursement of his outlays, duly justified.

The emolument is calculated separately on the auction price of each lot, even if several separate lots are auctioned separately to the same successful bidder. However, the emolument is calculated on the price of the lots combined if the auction takes place after the total or partial combination of the lots put up for sale.

Lorsque le montant de l’adjudication ne dépasse pas 30 €, le notaire n’a droit qu’au remboursement de ses débours, dûment justifiés.

L’émolument est calculé séparément sur le prix d’adjudication de chaque lot, même si plusieurs lots distincts sont adjugés séparément au même adjudicataire. Toutefois, l’émolument est calculé sur le prix des lots réunis si l’adjudication a lieu après la réunion totale ou partielle des lots mis en vente.
