Article A444-140 of the French Commercial code

Translations of mortgages (numbers 129 and 130 of table 5) give rise to the collection of:

1° Where the translation relates to the entire pledge, the same fees as those provided for in article A. 444-136 in respect of mortgage assignment;

2° Where the translation is partial, the fees mentioned in 1°, collected on a sum set by applying to the amount of the claim the ratio existing between the value of the asset released and that of the entire pledge.

Les translations d’hypothèque (numéros 129 et 130 du tableau 5) donnent lieu à la perception :


1° Lorsque la translation porte sur la totalité du gage, aux mêmes émoluments que ceux prévus à l’article A. 444-136 en matière d’affectation hypothécaire ;


2° Lorsque la translation est partielle, aux émoluments mentionnés au 1°, perçus sur une somme fixée en appliquant au montant de la créance le rapport existant entre la valeur du bien dégrevé et celle de la totalité du gage.
