Article A444-148 of the French Commercial code

Pledges and pledges as well as agricultural warrants (numbers 146 and 147 of table 5) give rise to the collection of:

1° Where they are granted by a third party in the main deed : a quarter of the fees for the main deed;

2° Where there is no main deed: the fees that would have been charged for that deed;

3° In cases other than those provided for in 1° and 2°: half the fees for the main deed.

Le nantissement et le gage ainsi que le warrant agricole (numéros 146 et 147 du tableau 5) donnent lieu à la perception :


1° Lorsqu’il est consenti par un tiers dans l’acte principal : au quart des émoluments de l’acte principal ;


2° Lorsqu’il n’y a pas d’acte principal : aux émoluments qui auraient été perçus sur cet acte ;


3° Dans les autres cas que ceux prévus aux 1° et 2° : à la moitié des émoluments de l’acte principal.
