Article A444-166 of the French Commercial code

The filing of private deeds other than holograph wills (number 173 in table 5) gives rise to the collection of :

1° If the filing is made by all the persons who have signed the deed filed with recognition of their signatures, to an emolument equal to that to which the authentic deed containing the same agreement would have given rise;

2° If the filing is not made by all the persons referred to in 1° or if they do not require recognition of their writings and signatures, to half the emolument provided for in 1°.

Le dépôt d’actes sous seing privé autres que les testaments olographes (numéro 173 du tableau 5) donne lieu à la perception :


1° Si le dépôt est fait par toutes les personnes qui ont signé l’acte déposé avec reconnaissance de leurs signatures, à un émolument égal à celui auquel aurait donné lieu l’acte authentique contenant la même convention ;


2° Si le dépôt n’est pas fait par toutes les personnes visées au 1° ou si celles-ci ne requièrent pas la reconnaissance de leurs écritures et signatures, à la moitié de l’émolument prévu au 1°.
