Article A444-170 of the French Commercial code

Checking the purchaser’s criminal record against the criminal record (number 181 of table 5) gives rise to the collection of the following fees:

1° In the case of acquisition by one or more natural persons or by a legal entity up to and including 5 partners: €37.73 per file;

2° In the case of acquisition by a legal entity, above 5 partners: €75.46 per file.

Renewal of the extract from the criminal record, with reinitialisation of the application, gives rise to the collection of a new fee set in accordance with the terms and conditions set out in 1° and 2° of this article.

La vérification de la situation pénale de l’acquéreur auprès du casier judiciaire (numéro 181 du tableau 5) donne lieu à la perception des émoluments suivants :

1° En cas d’acquisition par une ou plusieurs personnes physiques ou par une personne morale jusqu’à 5 associés inclus : 37,73 € par dossier ;

2° En cas d’acquisition par une personne morale, au-delà de 5 associés : 75,46 € par dossier.

Le renouvellement de l’extrait de casier judiciaire, avec réinitialisation de la demande, donne lieu à la perception d’un nouvel émolument fixé selon les modalités prévues aux 1° et 2° du présent article.
