Article A444-188 of the French Commercial code

In the case of seizure of property and sale by auction, unless otherwise provided, the interest in the dispute corresponds to the auction price of the property. In the case of a sale by lots, the interest in the dispute corresponds to the price of each lot, unless the auction takes place after the total or partial combination of the lots put up for sale.

For claims for partition, the interest in the dispute is defined according to the rules applicable to the basis of notaries’ fees specified in articles A. 444-54 and A. 444-55.

In matters of judicial sureties, the interest of the litigation corresponds to the amount of the guarantee taken as surety.

En matière de saisie immobilière et de licitation, sauf dispositions contraires, l’intérêt du litige correspond au prix d’adjudication du bien. En cas de vente par lots, l’intérêt du litige correspond au prix de chaque lot, sauf si l’adjudication a lieu après réunion totale ou partielle des lots mis en vente.

Pour les demandes en partage, l’intérêt du litige est défini selon les règles applicables à l’assiette des émoluments des notaires précisées aux articles A. 444-54 et A. 444-55.

En matière de sûretés judiciaires, l’intérêt du litige correspond au montant de la garantie prise en sûreté.
