Article A444-38 of the French Commercial code

The services listed under the following numbers in Table 3-2 give rise to the collection of fees equal to six tenths of the fixed and proportional fees, and the graduated fee, calculated pursuant to the a of article 34 of decree no. 47-817 of 9 May 1947 relating to the fees and emoluments of solicitors practising in the Haut-Rhin, Bas-Rhin and Moselle departments :

1° Number 136 (application for registration of judicial mortgage);

2° Number 138 (application for forced sale of real estate);

3° Number 139 (application for accession to forced sale of real estate);

4° Number 140 (application for forced administration of real estate).

Les prestations figurant aux numéros suivants du tableau 3-2 donnent lieu à la perception d’émoluments égaux à six dixièmes des émoluments fixes et proportionnels, et du droit gradué, calculés en application du a de l’article 34 du décret n° 47-817 du 9 mai 1947 relatif aux droits et émoluments des avocats postulants des départements du Haut-Rhin, du Bas-Rhin et de la Moselle :

1° Numéro 136 (requête en inscription hypothèque judiciaire) ;

2° Numéro 138 (requête en vente forcée immobilière) ;

3° Numéro 139 (requête en adhésion vente forcée immobilière) ;

4° Numéro 140 (requête en administration forcée immobilière).
