Article A444-44 of the French Commercial code

In the case of payment deadlines granted to a debtor, sued by virtue of a court decision or an enforceable deed or title, the service appearing under number 204 of table 3-3 gives rise to the collection, by the judicial officer who has been mandated to manage the case, of a fixed fee of €6.37 per instalment paid, with the exception of the payment of the balance.

This fee, which is payable by the debtor, is only due at the end of a period of six months from the first payment made by the debtor after the issue of the title.

For the management of a single case, the total amount of the fees collected pursuant to this article may not exceed €32.74.

En cas de délais de paiement accordés à un débiteur, poursuivi en vertu d’une décision de justice ou d’un acte ou d’un titre en forme exécutoire, la prestation figurant au numéro 204 du tableau 3-3 donne lieu à la perception, par l’huissier de justice ayant reçu mandat de gérer le dossier, d’un émolument fixe de 6,37 € par acompte versé, à l’exception du versement du solde.

Cet émolument, qui est à la charge du débiteur, n’est dû qu’à l’issue d’un délai de six mois à compter du premier versement effectué par le débiteur après la délivrance du titre.

Pour la gestion d’un même dossier, le montant total des émoluments perçus en application du présent article ne peut excéder 32,74 €.
