Article A444-69-1 of the French Commercial code

I.-For donations or legacies mentioned in 1° and 2° of article R. 444-11-1, the applicable rate is, where applicable, reduced to 0.45% for the portion of the base equal to or greater than €60,000 if it is higher than this percentage. In addition, the proportional emolument received by the notary in this case may not exceed €200,000.

II.-The two ceilings provided for in I apply to the sum of the emoluments received by the notary, which are, where applicable, capped in proportion to their respective amounts, where the notary receives several emoluments pursuant to the following provisions:

1° With regard to legacies, articles A. 444-59, A. 444-63, and A. 444-64, in particular its 2°;

2° With regard to gifts inter vivos that have not been accepted, the 2° and 3° of Article A. 444-67.

I.-Pour les donations ou legs mentionnés aux 1° et 2° de l’article R. 444-11-1, le taux applicable est, le cas échéant, réduit à 0,45 % pour la tranche d’assiette supérieure ou égale à 60 000 € s’il est supérieur à ce pourcentage. En outre, l’émolument proportionnel perçu par le notaire ne peut dans ce cas excéder 200 000 €.

II.-Les deux plafonnements prévus au I s’appliquent à la somme des émoluments perçus par le notaire, qui sont, le cas échéant, écrêtés au prorata de leurs montants respectifs, lorsque le notaire perçoit plusieurs émoluments en application des dispositions suivantes :

1° S’agissant des legs, les articles A. 444-59, A. 444-63, et A. 444-64, notamment son 2° ;

2° S’agissant des donations entre vifs non acceptées, le 2° et le 3° de l’article A. 444-67.
