Article A444-8 of the French Commercial code

I.-In the event of a forced sale, after the file has been forwarded by the bailiff to the judicial auctioneer, the latter may agree to postpone the sale in the event of an advance payment, at the written request of the debtor, without the number of such postponements being greater than five.

II.- In the case provided for in I, the service listed under number 13 of the table mentioned in article A 444-1 gives rise to a fixed fee for each postponement.In the case provided for in I, the service listed at number 13 in the table mentioned in article A. 444-1 gives rise to the collection of a fixed fee of 6.85 € on the occasion of each postponement.

III.-If the sale does not take place as a result of the debtor paying his debt, the service listed at number 14 in the table mentioned in article A. 444-1 gives rise to the collection of a fixed fee of 68.45 €.

IV.-If the sale does take place, the fees collected pursuant to II are deducted from those collected pursuant to article A. 444-3.

I.-En cas de vente forcée, après transmission du dossier par l’huissier de justice au commissaire-priseur judiciaire, ce dernier peut accepter de reporter la vente en cas de versement d’acompte, sur demande écrite du débiteur, sans que le nombre de ces reports puisse être supérieur à cinq.

II.-Dans le cas prévu au I, la prestation figurant au numéro 13 du tableau mentionné à l’article A. 444-1 donne lieu à la perception d’un émolument fixe de 6,85 € à l’occasion de chaque report.

III.-Si la vente n’a pas lieu par suite du paiement de sa dette par le débiteur, la prestation figurant au numéro 14 du tableau mentionné à l’article A. 444-1 donne lieu à la perception d’un émolument fixe de 68,45 €.

IV.-Si la vente a lieu, les émoluments perçus en application du II s’imputent sur ceux perçus en application de l’article A. 444-3.
