Article A444-96 of the French Commercial code

The first forward sale of residential premises mentioned in article A. 444-95 (number 60 of table 5) gives rise to the collection:

1° On the first deed containing the forward sale contract itself, of a proportional non-degressive emolument equal to that corresponding to the upper bracket of the sale emolument, taking into account the distinctions established in article A. 444-95 according to the number of main dwelling units concerned by the building permit;

2° On the second notarised deed transferring ownership after completion of the building work, an emolument calculated in accordance with the procedures set out in Article A. 444-95, less the emolument already collected under 1° of this article, increased by 79.24 €.

La première vente à terme d’un local d’habitation mentionné à l’article A. 444-95 (numéro 60 du tableau 5) donne lieu à la perception :

1° Sur le premier acte contenant le contrat de vente à terme proprement dit, d’un émolument proportionnel non dégressif égal à celui correspondant à la tranche supérieure de l’émolument de vente, en tenant compte des distinctions établies à l’article A. 444-95 en fonction du nombre d’unités principales d’habitation concernées par le permis de construire ;

2° Sur le second acte notarié portant transfert de propriété après achèvement des travaux de construction, d’un émolument calculé selon les modalités prévues à l’article A. 444-95, diminué de l’émolument déjà perçu en vertu du 1° du présent article, augmenté de 79,24 €.
