Article A822-11 of the French Commercial code

A trainee who wishes to complete part of his or her training period in France with a person other than a statutory auditor registered on the list provided for in article L. 822-1, or all or part of his or her training period abroad, shall obtain authorisation from the regional council.

It is issued on the basis of the following document(s):

– a certificate issued by the training supervisor, confirming that the latter will accept the trainee, and specifying the date chosen for the start of the training period;

– where applicable, a document from the competent authority of the foreign State justifying that the person with whom the candidate plans to carry out the training period is approved to carry out statutory audits and that it offers sufficient guarantees regarding the training of the trainee.

This authorisation mentions the name, position and address of the training supervisor and the date on which the training period begins.

The competent regional council is the one to which the trainee was previously subject or, if the trainee has not yet begun his or her traineeship, the regional council designated for this purpose by the national council.

The regional council which authorised the traineeship is responsible for supervising it.

Trainees who complete their traineeship abroad are subject to the same work, training and reporting obligations as trainees completing their traineeship in France.

Le stagiaire qui souhaite effectuer une partie de son stage en France chez une personne autre qu’un commissaire aux comptes inscrit sur la liste prévue à l’article L. 822-1, ou tout ou partie de son stage à l’étranger, obtient l’autorisation du conseil régional.

Elle est délivrée au vu de la ou des pièces suivantes :

– une attestation délivrée par le maître de stage, par laquelle celui-ci confirme accueillir le stagiaire, en précisant la date retenue pour le début du stage ;

– le cas échéant, un document émanant de l’autorité compétente de l’Etat étranger justifiant que la personne chez laquelle le candidat envisage d’effectuer son stage est agréée pour exercer le contrôle légal des comptes et qu’elle offre des garanties suffisantes quant à la formation du stagiaire.

Cette autorisation mentionne le nom, la qualité et l’adresse du maître de stage ainsi que la date du début du stage.

Le conseil régional compétent est celui dont relevait précédemment le stagiaire ou, si celui-ci n’a pas encore commencé son stage, le conseil régional désigné à cet effet par le conseil national.

Le conseil régional qui a autorisé le stage en assure le contrôle.

Le stagiaire qui effectue son stage à l’étranger est soumis aux mêmes obligations de travaux, de formation et de rapports que le stagiaire effectuant son stage en France.
