Article A822-2-1 of the French Commercial code

Applicants holding a diploma obtained in a foreign State who wish to benefit from the provisions of the first paragraph of article R. 822-2 send to the Keeper of the Seals, Minister of Justice, by 30 September at the latest, a file in duplicate comprising:

1° All official documents proving their identity and nationality;

2° All proof of the diplomas, certificates or titles they hold;

3° All proof enabling the content and level of post-secondary studies successfully completed to be assessed.

Applicants wishing to benefit from the provisions of 3° of Article R. 822-2 shall send to the Minister of Justice, Keeper of the Seals, by 30 April at the latest, a file in duplicate comprising:

1° All official documents proving their identity and nationality;

2° All proof of the diplomas, certificates or degrees they hold;

3° All proof making it possible to assess the content and level of post-secondary studies successfully completed.

Applicants under the provisions of the first paragraph of Article R. 822-5 provide the Keeper of the Seals, Minister of Justice, by 30 April at the latest, with a file in duplicate comprising:

1° All official documents proving their identity and nationality;

2° All documentary evidence establishing that they have exercised a public or private activity for at least fifteen years which has enabled them to acquire sufficient experience in the financial, accounting and legal fields relevant to commercial companies.

The documents produced shall be accompanied, where applicable, by a translation into French by a translator approved by the French courts or authorised to act before the judicial or administrative authorities of a Member State of the European Union or party to the Agreement on the European Economic Area.

On receipt of the complete application, a receipt will be issued. Candidates are admitted to take the preparatory certificate for the duties of statutory auditor or the certificate of aptitude for the duties of statutory auditor, depending on the case, by reasoned decision of the Minister of Justice. This decision must be taken within two months of the date of issue of the receipt. Failure to respond within this period will be deemed to constitute rejection of the application.

Les candidats titulaires d’un diplôme obtenu dans un Etat étranger qui souhaitent bénéficier des dispositions du premier alinéa de l’article R. 822-2 adressent au garde des sceaux, ministre de la justice, au plus tard le 30 septembre, un dossier en double exemplaire comprenant :

1° Tous documents officiels justificatifs de leur identité et de leur nationalité ;

2° Tout justificatif des diplômes, certificats ou titres dont ils sont titulaires ;

3° Tout justificatif permettant d’apprécier le contenu et le niveau d’études postsecondaires suivies avec succès.

Les candidats qui souhaitent bénéficier des dispositions du 3° de l’article R. 822-2 adressent au garde des sceaux, ministre de la justice, au plus tard le 30 avril, un dossier en double exemplaire comprenant :

1° Tous documents officiels justificatifs de leur identité et de leur nationalité ;

2° Tout justificatif des diplômes, certificats ou titres dont ils sont titulaires ;

3° Tout justificatif permettant d’apprécier le contenu et le niveau d’études postsecondaires suivies avec succès.

Les candidats au titre des dispositions du premier alinéa de l’article R. 822-5 fournissent au garde des sceaux, ministre de la justice, au plus tard le 30 avril, un dossier en double exemplaire comprenant :

1° Tous documents officiels justificatifs de leur identité et de leur nationalité ;

2° Tout justificatif établissant qu’ils ont exercé pendant une durée de quinze ans au moins une activité publique ou privée qui leur a permis d’acquérir une expérience suffisante dans les domaines financier, comptable et juridique intéressant les sociétés commerciales.

Les pièces produites sont accompagnées, le cas échéant, de leur traduction en langue française par un traducteur agréé auprès des tribunaux français ou habilité à intervenir auprès des autorités judiciaires ou administratives d’un Etat membre de l’Union européenne ou partie à l’accord sur l’Espace économique européen.

A réception du dossier complet, un récépissé leur est délivré. Les candidats sont admis à se présenter, selon le cas, au certificat préparatoire aux fonctions de commissaire aux comptes ou au certificat d’aptitude aux fonctions de commissaire aux comptes par décision motivée du garde des sceaux. Cette décision doit intervenir dans un délai de deux mois à compter de la délivrance du récépissé. Le défaut de réponse dans ce délai vaut rejet de la demande.
