“No one may be entered on the list of sworn merchandise brokers of a court of appeal unless he fulfils the following conditions:

1° Be French or a national of a Member State of the European Union or of another State party to the Agreement on the European Economic Area;

2° Not have been subject to personal bankruptcy or any other sanction pursuant to Title V of Book VI or to previously applicable provisions and not have been the perpetrator of acts contrary to honour or probity that have given rise to a criminal conviction or acts that have given rise to a disciplinary or administrative sanction of removal from office, striking off the roll, revocation, withdrawal of approval or authorisation in the profession previously exercised ;

3° Be entered in the trade and companies register in a personal capacity;

4° Be authorised to conduct voluntary sales of furniture by public auction and have practised for at least two years in the professional speciality for which registration is requested (as of 1 January 2015);

5° Have successfully passed the qualifying examination in one or more of the professional specialities for which registration is requested within the last three years;

6° Have their residence within the jurisdiction of the Court of Appeal. “

” Nul ne peut être inscrit sur la liste des courtiers de marchandises assermentés d’une cour d’appel s’il ne remplit les conditions suivantes :

1° Etre français ou ressortissant d’un Etat membre de l’Union européenne ou d’un autre Etat partie à l’accord sur l’Espace économique européen ;

2° N’avoir pas été frappé de faillite personnelle ou d’une autre sanction en application du titre V du livre VI ou des dispositions antérieurement applicables et n’avoir pas été l’auteur de faits contraires à l’honneur ou à la probité ayant donné lieu à condamnation pénale ou de faits ayant donné lieu à une sanction disciplinaire ou administrative de destitution, radiation, révocation, de retrait d’agrément ou d’autorisation dans la profession exercée antérieurement ;

3° Etre inscrit au registre du commerce et des sociétés à titre personnel ;

4° Etre habilité à diriger des ventes volontaires de meubles aux enchères publiques et avoir exercé son activité pendant deux ans au moins dans la spécialité professionnelle pour laquelle l’inscription est demandée (à compter du 1er janvier 2015) ;

5° Avoir subi avec succès depuis moins de trois ans l’examen d’aptitude dans une ou plusieurs spécialités professionnelles pour lesquelles l’inscription est demandée ;

6° Avoir sa résidence dans le ressort de la cour d’appel. ”

Certifie sur l’honneur n’avoir pas été l’auteur de faits ayant donné lieu à une sanction disciplinaire ou administrative de destitution, radiation, révocation, de retrait d’agrément ou d’autorisation dans la profession que j’exerçais, le cas échéant, antérieurement.
