Article Annexe 11-1 of the French Public Health Code

STANDARD AGREEMENT RELATING TO THE CONDITIONS OF INTERVENTION OF VOLUNTEERS ACCOMPANYING PEOPLE IN PALLIATIVE CARE IN HEALTH ESTABLISHMENTS AND SOCIAL AND MEDICO-SOCIAL ESTABLISHMENTS MENTIONED IN ARTICLE R. 1110-1

Between the establishment …, hereinafter referred to as the establishment at …, represented by …, and the association…. at …., hereinafter referred to as the association, represented by …, the following is agreed:

Art. 1. – The establishment undertakes to prepare its staff and private practitioners for the work of the association’s volunteers through awareness-raising initiatives.

Art. 2 – The association is responsible for the selection, training and ongoing support of volunteers, as well as the operation of the team of volunteers, in accordance with the following procedures:…

Art. 3 – The association will provide the school with a list of the names of the members of the team of volunteers who will be called upon to give their services, and who will undertake to..:

– to comply with the association’s charter, this agreement and the establishment’s internal rules ;

– to attend training courses and meetings designed to provide ongoing support and the necessary regulation of their activities.

Art. 4 – The association will inform the establishment of the name of the volunteer coordinator it has appointed. The role of this co-ordinator is to organise the work of the volunteers with the patients and, where applicable, their relatives, to liaise with the care team and to iron out any difficulties that may arise during the work of a volunteer.

Art. 5 – In order to ensure that people receiving palliative care and their families are informed about the possibility of volunteer involvement, the principles involved, the role of volunteers and the limits of this involvement, the establishment and the association have adopted the following provisions:….

Art. 6 – The identity of persons requesting support from the team of volunteers is communicated to the volunteer coordinator by the correspondent appointed by the establishment.

Art. 7 – The parties undertake to respect a reciprocal obligation to provide information about the person cared for by the team of volunteers, in accordance with the terms and conditions set out below, which define in particular the type of information that must be shared in order to fulfil their respective roles, while respecting professional secrecy:…

Art. 8 – The establishment undertakes to make the material arrangements necessary for the work of the association’s volunteers working within it.

Art. 10 – The parties to this agreement will draw up an annual report on the work carried out by the volunteers.

Art. 11 – This agreement, drawn up for a period of one year, is renewed by tacit agreement. Except in emergency situations, the agreement may only be terminated after two months’ notice has been given by registered letter with acknowledgement of receipt.

CONVENTION TYPE RELATIVE AUX CONDITIONS D’INTERVENTION DES BÉNÉVOLES ACCOMPAGNANT LES PERSONNES EN SOINS PALLIATIFS DANS LES ÉTABLISSEMENTS DE SANTÉ ET LES ÉTABLISSEMENTS SOCIAUX ET MÉDICO-SOCIAUX MENTIONNÉE À L’ARTICLE R. 1110-1

Entre l’établissement …, ci-dessous dénommé l’établissement sis …, représenté par …, et l’association…. sise …. ci-dessous dénommée l’association, représentée par…, il est convenu ce qui suit :

Art. 1er. – L’établissement s’engage à préparer. par des actions de sensibilisation. son personnel et les intervenants exerçant à titre libéral à l’intervention des bénévoles de l’association.

Art. 2. – L’association assure la sélection, la formation à l’accompagnement et le soutien continu des bénévoles ainsi que le fonctionnement de l’équipe de bénévoles, selon les modalités suivantes :…

Art. 3. – L’association transmet à l’établissement la liste nominative des membres de l’équipe de bénévoles appelés à intervenir qui s’engagent :

– à respecter la charte de l’association, la présente convention et le règlement intérieur de l’établissement ;

– à suivre la formation et à participer aux rencontres visant au soutien continu et à la régulation nécessaire de leur action.

Art. 4. – L’association porte à la connaissance de l’établissement le nom du coordinateur des bénévoles qu’elle a désigné. Le rôle de ce coordinateur est d’organiser l’action des bénévoles auprès des malades et. le cas échéant, de leur entourage, d’assurer la liaison avec l’équipe soignante et d’aplanir les difficultés éventuelles survenues lors de l’intervention d’un bénévole.

Art. 5. – En vue d’assurer l’information des personnes bénéficiaires de soins palliatifs et de leur entourage de la possibilité de l’intervention de bénévoles, de ses principes, de leur rôle et des limites de cette intervention, l’établissement et l’association arrêtent les dispositions suivantes :….

Art. 6. – L’identité des personnes qui demandent un accompagnement de l’équipe des bénévoles est communiquée au coordinateur des bénévoles par le correspondant désigné par l’établissement.

Art. 7. – Les parties s’engagent à respecter une obligation d’informaréciproque sur la personne suivie par l’équipe de bénévoles, selon les modalités ci-dessous qui définissent notamment le type d’informations devant être partagées pour l’accomplissement de leur rôle respectif, dans le respect du secret professionnel :…

Art. 8. – L’établissement s’engage à prendre les dispositions matérielles nécessaires à l’intervention des bénévoles de l’association oeuvrant en son sein.

Art. 9. – L’association déclare être couverte en responsabilité civile pour les dommages susceptibles d’être causés par ses membres à l’occasion de leurs interventions au sein de l’établissement par l’assurance… L’établissement déclare être couvert en responsabilité civile pour les dommages susceptibles d’être occasionnés aux bénévoles de l’association au sein de l’établissement par l’assurance …

Art. 10. – Les parties à la présente convention établissent un bilan annuel de l’intervention des bénévoles.

Art. 11. – La présente convention, établie pour une durée de un an, est renouvelée par tacite reconduction. Le contrat, sauf situation d’urgence, ne peut être dénoncé qu’après un préavis de deux mois notifié par lettre recommandée avec accusé de réception.
