The declaration with a view to the registration of the association or the registration of any amendment to the articles of association is made at the court registry by a member of the association’s management.
The declaration specifies, where applicable, the profit-making purpose and recognition as being in the public interest, the object, the name and the address of the association’s registered office or domicile.
When it is made with a view to registering the association, the declaration also mentions the surname, forenames, domicile, nationality and, for legal entity members, the legal form and registration number, of each of the members of the management as well as their position within the association. A summary of the purpose of the articles of association, to be published in a legal gazette as provided for in article 66 of the local civil code, is attached to this declaration. The declaration shall include the surnames and first names of the signatories of the articles of association attached pursuant to article 59 of the same code.
Where the declaration is made with a view to registering the change in the registered office of the association outside the jurisdiction of the court holding the register in which it is registered, that court shall forward the association’s file to the court within whose jurisdiction it has its new registered office. The said court, after verifying the condition laid down in the second paragraph of article 57 of the local civil code, shall enter the association in the register it keeps and inform the court of origin, which shall order the association’s removal from the register it keeps.
A dated receipt for the declaration shall be sent to the declarant within five days.
