Article ANNEXE, art. 30-2 of the French Code of civil procedure

In the case provided for in article 60 of the local civil code, the court shall hear the observations of the association’s management or request them before making an order rejecting the declaration.

It may also refer the declaration, as it stands, to a hearing, the date of which it shall set. The members of the management are summoned to the hearing at least eight days in advance by the clerk of the district court. The decision to reject the declaration must be made within one month of the date of issue of the receipt provided for in article 30-1.

In all other cases, he must forward the declaration to the representative of the State in the department within the same time limit, who will acknowledge receipt.

Dans le cas prévu à l’article 60 du code civil local, le tribunal recueille les observations de la direction de l’association ou les lui demande avant de prendre une ordonnance de rejet de la déclaration.

Il peut aussi renvoyer la déclaration, en l’état, à une audience dont il fixe la date. Les membres de la direction y sont convoqués huit jours au moins à l’avance par le greffier du tribunal d’instance. La décision de rejet intervient au plus tard dans le délai d’un mois à compter de la délivrance du récépissé de déclaration prévu à l’article 30-1.

Dans les autres cas, il communique dans le même délai la déclaration au représentant de l’Etat dans le département, qui en accuse réception.
