Article ANNEXE, art. 33 of the French Code of civil procedure

The document instituting proceedings and the order of the president shall be served at least fifteen days before the date set. The service shall indicate, on pain of nullity, the period within which the defendant is required to constitute a lawyer. The document served shall be deemed to be the submissions.

The case shall be heard in accordance with the provisions of articles 762, 763 and 776 to 808 of the code of civil procedure.

L’acte introductif d’instance et l’ordonnance du président sont signifiés quinze jours au moins avant la date fixée. La signification indique, à peine de nullité, le délai dans lequel le défendeur est tenu de constituer avocat. L’acte signifié vaut conclusions.

L’affaire est instruite selon les dispositions des articles 762, 763 et 776 à 808 du code de procédure civile.
