Article ANNEXE, art. 43 of the French Code of civil procedure

With regard to enforcement proceedings and taxation of the parties’ costs, appeals follow the rules relating to appeals in non-contentious matters.

The same applies to appeals under article 699 of the local code of civil procedure, article 17 (paragraph 2) of the law of 30 June 1878 relating to indemnities granted to witnesses and experts, articles 4 and 16 of the Empire law of 20 May 1898 on court fees and article 9 of the decree of 9 May 1947 relating to the fees and emoluments of postulant lawyers in the departments of Haut-Rhin, Bas-Rhin and Moselle and in matters relating to the taxation of notary fees.

En matière de voies d’exécution et taxation des frais des parties, les pourvois suivent les règles relatives aux pourvois en matière gracieuse.

Il en est de même des pourvois prévus par les articles 699 du code de procédure civile locale, 17 (alinéa 2) de la loi du 30 juin 1878 relative aux indemnités accordées aux témoins et experts, 4 et 16 de la loi d’Empire du 20 mai 1898 sur les frais de justice et 9 du décret du 9 mai 1947 relatif aux droits et émoluments des avocats postulants des départements du Haut-Rhin, du Bas-Rhin et de la Moselle et en matière de taxation des frais de notaire.
