Article D1-11-2 of the French Code of Criminal Procedure

Prior to any release or cessation, even temporary, of the imprisonment of a detained person prosecuted or convicted for offences committed within the couple covered by article 132-80 du code pénal, or for the offence defined in article 227-4-2 of the same code, the competent judicial authority, after notifying the victim, shall assess, in accordance with articles 144-2 and 712-16-2 of this code.

1° If a ban on contact with the victim or on appearing in certain places as provided for by article 138 of this Code or by 9°, 11°, 12°, 13°, 18° and 18° bis of article 132-45 of the Penal Code;

2° If the effectiveness of this prohibition must be reinforced by the use of a remote protection device pursuant to article 41-3-1 of this code or a mobile anti-seizure device pursuant to Articles 138-3 of this code or 132-45-1 du code pénal.

The provisions of this article do not apply in the event of an escorted exit permit.

Where a convicted person is concerned, the sentence enforcement judge may, in order to assess whether it is appropriate to apply the measures provided for in 1° and 2°, have an in-depth assessment of the victim carried out in accordance with the provisions of Article D. 1-10.

Avant toute libération ou cessation, même temporaire, de l’incarcération d’une personne détenue poursuivie ou condamnée pour des infractions commises au sein du couple relevant de l’article 132-80 du code pénal, ou pour l’infraction définie à l’article 227-4-2 du même code, l’autorité judiciaire compétente, après en avoir avisé la victime, apprécie, conformément aux articles 144-2 et 712-16-2 du présent code.

1° Si doit être prononcée une interdiction de contact avec la victime ou de paraître en certains lieux prévues par l’article 138 du présent code ou par les 9°, 11°, 12°, 13°, 18° et 18° bis de l’article 132-45 du code pénal ;

2° Si l’effectivité de cette interdiction doit être renforcée par le recours à un dispositif de téléprotection en application de l’article 41-3-1 du présent code ou à un dispositif mobileanti-rapprochement en application des articles 138-3 du présent code ou 132-45-1 du code pénal.

Les dispositions du présent article ne sont pas applicables en cas d’autorisation de sortie sous escorte.

Lorsqu’il s’agit d’une personne condamnée, le juge de l’application des peines peut, pour apprécier s’il convient d’appliquer les mesures prévues aux 1° et 2°, faire procéder à une évaluation approfondie de la victime conformément aux dispositions de l’article D. 1-10.
