I.-In the event of non-compliance with the quality limits defined by the order referred to in article D. 1332-2 being observed during the monitoring of the installations referred to in I of article D. 1332-10 or during the health inspection referred to in II of article D. 1332-10, the person responsible for the swimming pool shall immediately:
1° Take the necessary corrective measures to restore the swimming pool water to conformity;
2° Take the necessary measures to protect bathers during the period required for the water to return to conformity.
II.-In the event of non-compliance with the quality references defined by the order referred to in Article D. 1332-2 during the monitoring of the installations referred to in I of Article D. 1332-10 or during the health inspection referred to in II of Article D. 1332-10, the person responsible for the swimming pool shall, after investigating the cause, take the necessary corrective measures to restore the quality of the swimming pool water.
III. – When the person responsible for the swimming pool considers that the water is not in compliance with the quality references defined by the order referred to in Article D. 1332-2, the person responsible for the swimming pool shall take the necessary corrective measures to restore the quality of the swimming pool water.When the Director General of the Regional Health Agency considers that the swimming pool water or the hygiene of the establishment presents a risk to people’s health or that the facilities are not working properly on a permanent basis, and whether or not the quality limits and references have been respected or met, the Director General of the Regional Health Agency informs the Prefect, who may ask the person responsible for the swimming pool to restrict or even prohibit access to the pool or to take any other measure necessary to protect people’s health. The person responsible for the pool will inform the Director General of the Regional Health Agency of the application of the measures taken.
IV – The person responsible for the swimming pool will define an internal procedure for managing situations where quality limits are not respected, quality references are not met and for managing exceptional situations, in particular the presence of faecal matter or vomit in a pool. These procedures are made available to the health inspectors mentioned in article L. 1332-8, at the establishment.
