The census procedure initiated by the municipality, as provided for in article L. 1332-1, aims to establish before each bathing season the list of bathing waters subject to the provisions of this section. This procedure provides for public information and participation during the preceding bathing season.
Each year, the municipality shall initiate the procedure for listing the bathing waters defined in article L. 1332-2 located within its territory by 1 July at the latest or, in the overseas departments, Mayotte, Saint-Barthélemy and Saint-Martin, by 1 November at the latest.
The local authority informs the public of the implementation of this procedure and its details by posting notices in the town hall and, as far as possible, near the waters where bathing is usually practised. During the period from 1st July to 30th September each year or, in the overseas departments, Mayotte, Saint-Barthélemy and Saint-Martin, from 1st November to 31st January, the public can make comments on the waters they consider to be suitable for bathing during the following bathing season. These comments are recorded in a register made available to the public at the town hall, where it is kept for one year. The local authority draws up a summary of the comments made by the public.
The municipality informs those declaring bathing facilities as defined in article D. 1332-39, opened during the current bathing season that, unless they object in writing by 30 November of the current year at the latest or, in the overseas departments, Mayotte, Saint-Barthélemy and Saint-Martin, by 31 March of the current year at the latest, their bathing water will be included in the list of bathing waters surveyed by the local authority for the following bathing season and that the foreseeable duration of the following bathing season will be the actual duration of the current bathing season.
Persons wishing to open an equipped bathing facility on the territory of the municipality during the following bathing season must make the declaration provided for in article L. 1332-1 to the municipality by 30 November of the current year at the latest or, in the overseas departments, Mayotte, Saint-Barthélemy and Saint-Martin, by 31 March of the current year at the latest. This declaration must specify the foreseeable duration of the following bathing season.
The prefect gives formal notice to the mayor of the municipality to meet these obligations if the municipality does not comply with the census procedures set out in this article.
