Article D1434-44 of the French Public Health Code

The territorial health professional community set up under the conditions of article L. 1434-12 may, in application of article L. 1434-12-1, pay allowances or remuneration to its members.

The allowances referred to in the previous paragraph are determined in such a way as to compensate for the loss of income suffered by the members as a result of the duties they perform within the territorial professional healthcare community. The remuneration mentioned in the same paragraph corresponds to the consideration for the participation of the members in carrying out the public service missions of the territorial professional healthcare community.

For each professional who is a member of the community or practises in a structure that is a member of the community, the total sum of allowances or remuneration received in application of this article during a calendar year may not exceed the annual value of the ceiling mentioned inarticle L. 241-3 of the Social Security Code.

La communauté professionnelle territoriale de santé constituée dans les conditions de l’article L. 1434-12 peut verser, en application de l’article L. 1434-12-1, des indemnités ou des rémunérations au profit de ses membres.

Les indemnités mentionnées à l’alinéa précédent sont déterminées de manière à compenser la perte de revenus subie par les membres en raison des fonctions qu’ils exercent au sein de la communauté professionnelle territoriale de santé. Les rémunérations mentionnées au même alinéa correspondent à la contrepartie de la participation des membres à la réalisation des missions de service public de la communauté professionnelle territoriale de santé.

Pour chaque professionnel, membre de la communauté ou exerçant dans une structure adhérente à la communauté, la somme totale des indemnités ou rémunérations perçues en application du présent article durant une année civile ne peut excéder la valeur annuelle du plafond mentionné à l’article L. 241-3 du code de la sécurité sociale.
