Article D1873-1 of the French General Code of Local Authorities

I. – Articles R. 1614-75 to R. 1614-77, articles R. 1614-78 and R. 1614-79, with the exception of e, R. 1614-80, R. 1614-83 to R. 1614-89 with the exception of the last paragraph and articles R. 1614-91 to R. 1614-95 are applicable to the communes of French Polynesia subject to the adaptations provided for in II to VIII.

II. – For the application of article R. 1614-75 and R. 1614-77, the words: “and departmental lending libraries”, “and departmental” are deleted.

III. – For the application of articles R. 1614-78 and R. 1614-88 :

1° The words: “, public establishments for inter-municipal cooperation and departments” are replaced by the words: “and public establishments for inter-municipal cooperation”;

2° deleted;

3° The words: “provided for by Articles L. 111-7 to L. 111-7-4 of the Construction and Housing Code” are replaced by the words: “in accordance with locally applicable regulations”.

IV. – For the application of article R. 1614-79, the words: “of the overseas departments and Saint-Pierre-et-Miquelon” are replaced by the words: “of French Polynesia”.

V. – For the application of article R. 1614-83, the reference to articles R. 1614-78 to R. 1614-82 is replaced by the reference to articles R. 1614-78 to R. 1614-80 and the words: “or departmental” are deleted.

VI. – For the application of articles R. 1614-86, R. 1614-87, R. 1614-94 and R. 1614-95, the words: “, the public establishment for inter-municipal cooperation and the department” are replaced by the words: “or the public establishment for inter-municipal cooperation”.

VII.-For the application of article R. 1614-89, the words: “a regional capital or in a departmental capital” are replaced by the words: “the capital of French Polynesia” and the words: “of the overseas departments and Saint-Pierre-et-Miquelon” are replaced by the words: “of French Polynesia”.

VIII. – For the application of article R. 1614-91, the reference to article R. 1614-90 is replaced by the reference to article R. 1614-89 and the words: “or a departmental lending library” are deleted.

III. – Pour l’application des articles R. 1614-78 et R. 1614-88 :

1° Les mots : “, les établissements publics de coopération intercommunale et les départements ” sont remplacés par les mots : ” et les établissements publics de coopération intercommunale ” ;

2° supprimé ;

3° Les mots : ” prévus par les articles L. 111-7 à L. 111-7-4 du code de la construction et de l’habitation ” sont remplacés par les mots : ” conformément à la réglementation applicable localement “.

IV. – Pour l’application de l’article R. 1614-79, les mots : ” des départements d’outre-mer et de Saint-Pierre-et-Miquelon ” sont remplacés par les mots : ” de la Polynésie française ”.

V. – Pour l’application de l’article R. 1614-83, la référence aux articles R. 1614-78 à R. 1614-82 est remplacée par la référence aux articles R. 1614-78 à R. 1614-80 et les mots : ” ou départementaux ” sont supprimés.

VI. – Pour l’application des articles R. 1614-86, R. 1614-87, R. 1614-94 et R. 1614-95, les mots : “, l’établissement public de coopération intercommunale et le département ” sont remplacés par les mots : ” ou l’établissement public de coopération intercommunale ”.

VII.-Pour l’application de l’article R. 1614-89, les mots : ” un chef-lieu de région ou dans un chef-lieu de département ” sont remplacés par les mots : ” le chef-lieu de la Polynésie française ” et les mots : ” des départements d’outre-mer et de Saint-Pierre-et-Miquelon ” sont remplacés par les mots : ” de la Polynésie française “.

VIII. – Pour l’application de l’article R. 1614-91, la référence à l’article R. 1614-90 est remplacée par la référence à l’article R. 1614-89 et les mots : ” ou d’une bibliothèque départementale de prêt ” sont supprimés.
