Article D214-240 of the French Monetary and Financial Code

The Autorité de contrôle prudentiel et de résolution shall issue the authorisation referred to in Article L. 214-189 within thirty days of notification of receipt of the application. If no decision has been notified by the AMF by the end of this period, this shall be deemed to be an authorisation decision.

If the Authority requests additional information, it will notify the applicant in writing, specifying that the requested information must be received within sixty days. If the information is not received within this period, the application for authorisation is deemed to have been rejected. On receipt of all the information requested, the Authority will acknowledge receipt in writing. This acknowledgement of receipt shall specify a new time limit for examination, which may not exceed thirty days.

Pour la délivrance de l’agrément mentionné à l’article L. 214-189, l’Autorité de contrôle prudentiel et de résolution se prononce dans un délai de trente jours à compter de l’avis de réception de la demande. L’absence de notification de sa décision par l’Autorité au terme de ce délai vaut décision d’agrément.

Lorsque l’Autorité demande des informations complémentaires, elle le notifie par écrit en précisant que les éléments demandés doivent lui parvenir dans un délai de soixante jours. A défaut de réception de ces éléments dans ce délai, la demande d’agrément est réputée rejetée. Dès réception de l’intégralité des informations demandées, l’Autorité en accuse réception par écrit. Cet accusé de réception mentionne un nouveau délai d’instruction qui ne peut excéder trente jours.
