Article D214-32-7-8 of the French Monetary and Financial Code

The AIF or its management company shall inform of its intentions regarding the activity of the company concerned and the possible repercussions on employment, in particular any significant change in employment conditions:

1° The company concerned ;

2° The shareholders of the company concerned whose identity and contact details are made available to the AIF or its management company or can be obtained from the company concerned or appear in a register to which the AIF or its management company has access.

In addition, the AIF or its management company shall request and ensure that the board of directors of the company concerned, or its equivalent, makes the information mentioned in the first paragraph available to the employees’ representatives or, failing that, to the employees themselves.

Le FIA ou sa société de gestion informe de ses intentions relatives à l’activité de la société concernée et aux possibles répercussions sur l’emploi, notamment tout changement important des conditions d’emploi :

1° La société concernée ;

2° Les actionnaires de la société concernée dont l’identité et les coordonnées sont mises à la disposition du FIA ou de sa société de gestion ou peuvent être obtenues auprès de la société concernée ou figurent sur un registre auquel le FIA ou sa société de gestion peut avoir accès.

En outre, le FIA ou sa société de gestion demande et s’assure que le conseil d’administration de la société concernée, ou son équivalent, mette à la disposition des représentants des salariés ou, à défaut, des salariés eux-mêmes, les informations mentionnées au premier alinéa.
