Article D214-79-1 of the French Monetary and Financial Code

The Autorité des marchés financiers shall refuse to approve the creation of a local investment fund if, over a period of three years, each of the innovation mutual funds and local investment funds set up by the management company concerned has subscriptions totalling less than 5 million euros and if all the private equity funds referred to in articles L. 214-27 et seq. 214-27 et seq. and the professional investment funds referred to in article L. 214-159 managed by the management company represent total assets under management of less than 50 million euros.

L’Autorité des marchés financiers refuse d’agréer la constitution d’un fonds d’investissement de proximité lorsque, au cours d’une période de trois ans, chacun des fonds communs de placement dans l’innovation et des fonds d’investissement de proximité constitués par la société de gestion concernée présente un montant total de souscriptions inférieur à 5 millions d’euros et lorsque l’ensemble des fonds de capital investissement, mentionnés aux articles L. 214-27 et suivants, et des fonds professionnels de capital investissement, mentionnés à l’article L. 214-159, gérés par la société de gestion représente un montant total des actifs sous gestion inférieur à 50 millions d’euros.
