Article D2316-7 of the French Labour Code

The agreement between the works council and the central works council referred to in the fourth paragraph of Article L. 2316-23 includes in particular:

1° The description of the activity or activities whose management is transferred to the central social and economic committee;

2° The financing of the transfer for each year of execution of the agreement;

3° If applicable, the list of goods, material and human resources made available to the central social and economic committee for each year of execution of the agreement;

4° The methods of financing this transfer for each year of performance of the agreement;

5° The methods of access to the activity or activities transferred by the employees of the establishments concerned;

6° The duration of the agreement and its date of entry into force;

7° The procedures for revising and terminating the agreement.

La convention entre le comité social et économique d’établissement et le comité central mentionnée au quatrième alinéa de l’article L. 2316-23 comporte notamment :

1° La description de l’activité ou des activités dont la gestion est transférée au comité social et économique central ;

2° Le financement du transfert pour chaque année d’exécution de la convention ;

3° Le cas échéant, la liste des biens, moyens matériels et humains mis à la disposition du comité social et économique central pour chaque année d’exécution de la convention ;

4° Les modalités de financement de ce transfert pour chaque année d’exécution de la convention ;

5° Les modalités d’accès à l’activité ou aux activités transférées par les salariés des établissements concernés ;

6° La durée de la convention et sa date d’entrée en vigueur ;

7° Les modalités de révision et de dénonciation de la convention.
