Article D2372-9 of the French Labour Code

In order to distribute the seats allocated to each college between the trade union organisations, a quotient is calculated equal to the total number of elected representatives of this college in the social and economic committees or establishment social and economic committees of the companies, subsidiaries and establishments, divided by the number of seats allocated to this college.

Each trade union organisation is allocated as many seats per college as its number of elected representatives in that college contains times the quotient.

The seat(s) not allocated by application of the provisions of the second paragraph shall be allocated on the basis of the highest remainder. In the event of a tie, the seat goes to the trade union organisation that obtained the highest number of votes in the first round of the elections leading to the appointment of its elected representatives.

Pour procéder à la répartition des sièges alloués à chaque collège entre les organisations syndicales, il est calculé un quotient égal au nombre total d’élus de ce collège dans les comités sociaux et économiques ou comités sociaux et économiques d’établissement des sociétés, filiales et établissements, divisé par le nombre de sièges attribués à ce collège.


Il est attribué à chaque organisation syndicale, par collège, autant de sièges que son nombre d’élus dans ce collège contient de fois le quotient.


Le ou les sièges non attribués par application des dispositions du deuxième alinéa sont attribués au plus fort reste. En cas d’égalité de restes, le siège revient à l’organisation syndicale qui a obtenu le plus grand nombre de suffrages cumulés lors du premier tour des élections ayant conduit à la désignation de ses élus.
